Cheque Bouncing

Cheque bouncing, also known as dishonored cheque or bounced cheque, occurs when a cheque that is presented for payment at a bank is not honored due to insufficient funds/account closed/exceeds arragement in the account of the drawer (person who wrote the cheque). Here's an overview of what happens in the case of a bounced cheque:

  1. Notification of Bouncing: When a cheque bounces, the bank notifies the payee (person or entity to whom the cheque was issued) by returning the bounced cheque along with a 'Cheque Return Memo' stating the reason for dishonor, such as insufficient funds, account closed, mismatched signature, etc.

  2. Legal Implications: Bouncing a cheque is a criminal offense and lead to legal consequences for the drawer. The payee has the right to take legal action against the drawer to recover the amount owed,along with compensation .

  3. Legal Recourse: The payee can initiate legal proceedings against the drawer by sending a legal notice demanding payment within 30 days of cheque bouncing. If the drawer fails to pay the amount within the stipulated time of 15 days of receipt of notice , the payee can file a complaint in court for recovery of double the cheque amount.

  4. Civil vs. Criminal Proceedings: In some cases, bouncing a cheque may lead to both civil and criminal proceedings. Civil proceedings are initiated to recover the amount owed, while criminal proceedings are initiated to penalize the drawer for the offense of issuing a bounced cheque.

  5. Penalties and Consequences: The penalties for bouncing a cheque vary depending on the laws of the jurisdiction and the amount involved. Penalties may include fines, imprisonment, or both. Additionally, the drawer's credit rating may be affected, making it difficult for them to obtain credit or financial services in the future.

  6. Settlement and Resolution: In some cases, the drawer and payee may be able to reach a settlement or agreement outside of court to resolve the issue amicably. This could involve payment of the amount owed along with any applicable penalties or fees.
